Terms and Conditions

Effective Date: 04.09.2026
Last Updated:  04.09.2026

Introduction

These Terms and Conditions govern access to the Caelmontaris website and the individual seat reservation services offered on selected private aviation itineraries. By using the website, submitting a seat request, or completing a booking, you agree to these terms. Please read them before requesting a reservation. If you do not accept them, do not use the reservation service.

About Caelmontaris and Its Aircraft Operations

Caelmontaris is a Hong Kong-based private aviation business that owns and operates the aircraft used for its selected passenger itineraries. Individual passenger seats are offered directly by Caelmontaris on flights under its operational control. The aircraft assigned to each journey will be identified in the final booking documentation.

Caelmontaris is responsible for aircraft operations, crew, operational control, and the aviation permissions applicable to the flights it operates. It also manages reservations, office payments, passenger communications, and related arrangements. Aircraft descriptions on the website refer to aircraft owned and operated by Caelmontaris, although the specific aircraft assigned to an itinerary may change for operational reasons.

Website availability does not mean every route, aircraft, schedule, or seat remains available. A submitted request creates a temporary seat hold only after Caelmontaris accepts the request. It is not a completed booking or a promise that a flight will operate.

Eligibility and Passenger Information

You must have legal capacity to enter a contract. When submitting a request, you must provide accurate, current, and complete passenger, contact, and itinerary information. You must promptly correct any change. Caelmontaris may reject or cancel a request involving false details, unlawful activity, misuse, interference, or suspected fraud. You remain responsible for passports, visas, permits, entry conditions, and other documents required for the journey.

Seat Holds, Fare Disclosure, and Payment

An online seat request may place the selected seat on hold for forty-eight hours after Caelmontaris accepts the request, subject to itinerary availability. Caelmontaris will communicate whether the hold has been accepted. A submitted request awaiting acceptance does not reserve a seat.

To complete the booking, the passenger must visit the Caelmontaris office at Connaught Commercial Building, 185 Wan Chai Rd, Wan Chai, Hong Kong Island, Hong Kong within the hold period. Full payment must be made in person using an office payment method disclosed before payment. No booking payment is collected through the website.

Before payment, Caelmontaris will provide a written fare summary identifying the total amount, included taxes and airport charges, any conditional charges, cancellation conditions, the planned Caelmontaris aircraft, itinerary, and the period for which the fare remains available.

If payment is not completed within forty-eight hours after an accepted hold begins, the hold expires and the seat may be offered to another passenger. A contract arises only after payment is accepted and booking documentation is issued.

Schedules and Operational Changes

Published itineraries and departure times may change because of weather, air traffic directions, airport restrictions, security requirements, aircraft availability, mechanical circumstances, governmental action, or other events outside reasonable control. As the aircraft owner and flight operator, Caelmontaris may adjust the departure time, route, airport, assigned aircraft, or operational plan when reasonably required. Passengers will be informed using the contact details supplied. If Caelmontaris cancels an itinerary for a reason not caused by the passenger, it may offer an alternative arrangement. If no reasonable alternative is available, or the passenger declines an alternative that materially changes the paid itinerary, Caelmontaris will return the amount paid for the affected service. Mandatory passenger rights remain unaffected.

Arrival, Identification, and Boarding

Passengers must arrive at the designated departure location no later than sixty minutes before the scheduled departure time. Each passenger must present valid government-issued identification and every passport, visa, permit, or other document required for the itinerary.

Late arrival, missing or unacceptable documents, failure to complete required security procedures, or conduct creating a safety or legal concern may result in refused boarding. When refused boarding results from circumstances within the passenger’s responsibility, no refund is provided, except where mandatory law requires otherwise. Caelmontaris is not responsible for consequences arising from inaccurate, incomplete, expired, or missing passenger documents.

Passenger Cancellations

Cancellation requests must be sent to jetliner@caelmontaris.com and become effective when received by Caelmontaris. Requests received outside published support hours are treated as received when the next support period begins. Hong Kong Time applies to every cancellation deadline.

  • A request received at least twenty-four hours before scheduled departure qualifies for a refund of the full fare paid.
  • A request received less than twenty-four hours before scheduled departure, but before the sixty-minute reporting deadline, incurs a deduction equal to half of the fare. The remaining half is returned.
  • A cancellation received after the reporting deadline, a no-show, late arrival, or passenger-responsible boarding refusal receives no refund.

These rules apply to each passenger seat unless the booking documentation identifies several seats as one indivisible reservation. Mandatory legal rights remain unaffected.

Refund Process

After accepting an eligible cancellation, Caelmontaris will request the account details required for transfer. Passengers must provide complete and accurate information through the protected channel specified by Caelmontaris. Account information must not be sent through ordinary email.

Caelmontaris initiates an eligible transfer within twenty-four hours after receiving all required details. This initiation period runs continuously, including weekends and public holidays, unless a banking restriction prevents initiation. The receiving institution may take up to seven business days to display the funds. “Business day” means Monday through Friday, excluding Hong Kong public holidays.

Unless impracticable, a return will be made through the original payment method. Any alternative account must belong to the passenger or payer identified in the booking documentation.

Business Identity and Regulatory Status

The website and booking documentation will display Caelmontaris’s complete legal entity name, Hong Kong office address, business registration information, contact details, and status as the owner and operator of the aircraft used for the service. The planned aircraft will be identified before payment. Flights to or from Hong Kong remain subject to applicable aviation permissions and operating requirements.

Privacy

Caelmontaris collects and uses passenger information for reservation administration, identity processes, communications, refunds, aviation arrangements, compliance duties, and dispute handling. Personal data is handled under the Personal Data (Privacy) Ordinance (Cap. 486). Further information appears in the Privacy Policy. Passengers may contact jetliner@caelmontaris.com regarding personal data matters.

Liability and Passenger Rights

Nothing in these terms excludes or restricts liability where exclusion is unlawful. Subject to that rule, Caelmontaris is not liable for indirect or consequential loss arising from delays, schedule changes, airport restrictions, weather, air traffic directions, security events, or other circumstances beyond reasonable control. Any direct contractual liability is limited to the fare paid for the affected booking, so far as the Control of Exemption Clauses Ordinance (Cap. 71) permits.

Applicable aviation rights may arise under the Civil Aviation Ordinance (Cap. 448), the Air Navigation (Hong Kong) Order 1995 (Cap. 448C), the Carriage by Air Ordinance (Cap. 500), and applicable international carriage rules. The Unconscionable Contracts Ordinance (Cap. 458), Misrepresentation Ordinance (Cap. 284), Electronic Transactions Ordinance (Cap. 553), and other mandatory Hong Kong laws also remain applicable.

Changes to These Terms

Caelmontaris may revise these terms by publishing an updated version. Changes apply prospectively from the stated effective date and do not rewrite an existing completed booking unless law or the agreed booking documentation permits. Continued website use after publication means acceptance of the revised website terms.

Governing Law and Contact

These terms and related non-contractual matters are governed by Hong Kong law. Hong Kong courts have jurisdiction, subject to any mandatory rule or agreed dispute procedure.
